The "Buyer" describes the individual who acts/purchases in the role of final consumer, outside the scope of any business or profession. If you are not a "final consumer" we request that you do not purchase from the online shop www.babygi.pt.The Seller reserves the right not to process orders registered on www.babygi.pt when there are doubts as to the "Buyer's" final consumer status or when orders do not comply with the general terms of sale herein. These general terms and conditions of sale regulate exclusively the offer, acceptance of orders, transmission and shipments made through the site www.babygi.pt .
The "Buyer" shall provide the "Seller" with an e-mail address, postal address or other contact details which are correct and complete and accepts that the "Seller" may contact him/her using these details should it deem it necessary.
The "Seller" reserves the right to cancel any order, even if it has already been confirmed, in the following situations, disclaiming any liability for damages or costs:
• The product not being available anymore (payment will be returned);
• The billing information is not correct or verifiable;
• The order is flagged by our Security Systems as an incorrect OR fraudulent order;
• Payment is not received within 2 days of order acceptance;
• If there is evidence that the consumer is under the age of 18;
• If there are indications that the consumer is not a final consumer;
• If it is detected that the price indicated on the website is wrong;
• If it is not possible to deliver the order to the respective address;
All orders received are subject to verification, especially regarding the delivery address, the credibility of the consumer data and verification of fraud. Suspected fraud will be reported to the competent authorities.
We only accept the payment methods available in the shop:
ATM
By choosing the option to pay by ATM, a payment reference is issued taking into account the amount of your purchase. After confirmation of receipt of payment, your order will be shipped. After using the MB reference is automatically sent an email indicating that the payment was successful.
Payment method only available for purchases made in Portugal.
Payshop
When shopping on the internet, you can opt for the Payshop payment method. This will issue a reference that allows you to pay your order at any of our Payshop agents in a convenient and secure way without having to provide personal information.

Order processing will begin after payment has been received. Non-payment of an order within 2 working days of placing the order may significantly affect the continued availability of the product(s) ordered. Payments can only be processed if the billing data can be verified.
Your payment information will be encrypted in the Paypal system from the moment you enter it until your transaction is processed and will not be stored on a public server. Although we use encryption software, the security of information and payments transmitted over the Internet or via email cannot be guaranteed. The "Seller" shall not be liable for any damages suffered as a result of the use of electronic means of communication including, but not limited to, damages arising from failure or delay in the delivery of electronic communications, interception or manipulation of electronic communications by third parties or by computer programs used for communications or virus transmissions.

The prices of the products shown on the website are the final consumer prices.
8.1. The total price
The total price specified in the "Checkout" item includes taxes. Prices are quoted when confirming the order, which you can print out for future use.
8.2. Price changes
The prices of the products shown on the website are subject to change. The "Seller" reserves the right to change prices without notice. The prices displayed at the time of purchase are the prices applied to that purchase.
8.3. Price Errors
Please note that even though the site is updated with extreme care, it is possible that the price information on the site may contain errors.
The "Seller" does not sell on www.babygi.pt second hand products, with defects or of lower quality than Baby Gi's quality standards existing in the market. The main characteristics of each product displayed on www.babygi.pt can be found on each product page. The products displayed for sale on the website may not exactly match the actual garments in terms of image and colours, due to the Internet browser and monitor used.
All products have an identification tag attached. Do not remove the product label if you wish to return the purchased product. In case you decide to exercise the right to return the purchased products, the "Seller" has the right not to accept the return of products without the corresponding label, or that have been altered from their original state, where it denotes use of the same or damaged products.
10.1. Delivery
We deliver products Monday to Friday. We can only fulfil the delivery of an order if the delivery address is a home or office.
A delivery is considered to have taken place upon signature of the delivery receipt at the agreed address.
10.2. Delivery deadlines
Delivery is made up to 5 working days after payment confirmation. It is expected that the average delivery time is 48 hours. The "Vendor" makes deliveries using an external logistics company and is therefore subject to its availability to make deliveries. Holidays, days off, or other festive events may delay delivery.
The seller will not be liable for failure to perform, or delay in performance of, any obligation that is due to a force majeure event (an event, act or omission beyond its reasonable control).
10.3. Inspection on delivery
On delivery, the "Buyer" must inspect the packaging for any damage. If the products are found to be damaged, the "Buyer" must not accept delivery of the order and must return it. The "Seller" will refund the amounts paid for the order once the warehouse has received and completed the return process.
After receiving the order, it is important that the "Buyer" checks the delivered products within a period of 15 days, as the "Seller" considers that the "Buyer" has accepted the product(s) if they do not reject them within this period.
Shipping rates are applied per order. The price of each national expedition can vary between 5,70 to 8 euros by CttExpresso. For international shipping depending on the destination country, the cost of postage will be presented before making the payment of your order .
12.1. Order cancellation
The "Buyer" may cancel the order at no cost, provided that the order has not yet been shipped. If the "Buyer" places an order and wishes to cancel it, they should contact our Customer Service Department and request its cancellation. If this cancellation request has been approved, the "Buyer" will be notified by e-mail of this decision, and the cancellation will be processed free of charge for the "Buyer". If the cancellation request is not accepted, the products will be sent to the "Buyer" who, maintaining their intention to cancel the order, must refuse to receive them. The products will be returned and, upon reception, a refund of the value of the item(s) will be processed.
The shipping costs incurred by the non-acceptance of the order shall be borne by the "Buyer".
12.2. Return of defective products
The supplier of goods or service provider must reimburse the consumer for all payments received, including the cost of delivery of the goods.
The "Buyer" has the right to return delivered goods when they are found to be defective or otherwise non-compliant. The refund will be made within 14 days from the date on which we are informed of the decision to return the product, including the costs of delivery of the goods in accordance with paragraph 2 of Article 13 of Decree Law 24/2014 of February 14th. If your complaint is justified, the price of the product(s) ordered and the costs of their shipping (when borne by the "Buyer") will be refunded to the customer's account. 12.3 Return of products due to withdrawal
If for any reason the "Buyer" is not satisfied with the products they have ordered, they may return them within 15 days of receiving the order provided that:
• The products have not been washed or used. Except where the product contains information otherwise, the "Buyer" is entitled to try on the clothes to test the size and shape but may not wear them;
• The product maintains its original characteristics and the packaging is not damaged (carefully opened packages will not be considered damaged);
• The product is complete.
You cannot return:
• Products that have been tampered with and whose identification label is damaged.
The shipping costs incurred when returning a product due to purchase withdrawal will be borne by the "Buyer".
12.4. Product exchange
The exchange of products must be made within 15 (fifteen) days after reception. In this case, if the new order is of a higher cost, the user will have to bear the difference, adding to the exchange request the payment of the remainder.
12.5. Refund information
The refund will be made by bank transfer within 14 days after the exposure made by the "buyer" after the product(s) have been returned and processed. For additional information on the return procedure and refund times please refer to the Help/FAQ's section of the website.
Only the payment methods available on the site and explained in the Help/FAQ's section at www.babygi.pt are accepted.
The completion of orders registered on the site is subject to the availability of the respective products. The "Seller" tries to ensure that all items offered for sale on the site are in stock. However, the "Seller" reserves the right not to accept any orders or to cancel orders already confirmed for products that are not available. In such cases, the "Seller" will inform the "Buyer" of this fact and will proceed to refund the amount paid.
Promotions on the site are valid only for the period in which they are displayed, unless otherwise communicated on the site. The "Seller" is not bound by any offer. In the event of errors or mis-spellings, pricing, or otherwise, in the information on the site, the "Seller" reserves the right to cancel any purchase and sale made under such errors.
The "Seller" shall only be liable for damages suffered by the "Buyer" in the event that such damages result from breaches attributable to contractual obligations of the "Seller" towards the "Buyer", or in the event that the liability of the "Seller " results from applicable legal law.
In the event that the "Buyer" has suffered damages in connection with the activity of the website, the liability of the "Seller" shall be limited to:
• Damage to Baby Gi products;
• The maximum reimbursement for the above mentioned compensation will be (if applicable) the price of the products concerned.
The "Seller" shall not be liable for damages suffered by any third party resulting from the use of any of our products. The "Seller" shall not be liable for damages suffered by the "Buyer" as a result of improper use of its products.
The "Seller" is not liable for damages that result from incorrect information on the website.
In the event that the "Buyer" suffers damages that are the result of gross negligence or intent on the part of the "Seller" none of the limitations in this article shall apply.
These general conditions and all disputes arising in connection with these general conditions, including their validity, the use of the site, or any purchase on the site, shall be governed by Portuguese law.
The "Seller" has the right to amend these Terms & Conditions at any time. The "Buyer" is subject to the principles and terms enforced at the time of their order, unless any change to them is imposed by law or competent authority.
Although the "Seller" works their website with all due care, the information, texts, graphic documents, films, music and/or other services may contain errors or be incomplete or incorrect. The "Seller" shall not be liable for any damages resulting from the use (or inability to use) the website, including damages caused by viruses or any inaccuracy or imperfection of the information, unless such damage is the result of negligence on the part of the "Seller".
All trademarks, designs, text, documents, films, music product names, other site materials and titles used on the site are the property of the "Seller" and the user/consumer is prohibited from using or reproducing any of these items. Users/consumers are only permitted to electronically copy and print portions of the site if this is necessary to place an order or to use the site as a source for purchase. The user/consumer is not authorized to make any other use of the site or the information and materials contained therein, including reproduction for purposes other than the above, modification, distribution or republication. If the user/consumer wishes to use information or materials from the site, prior written permission must be obtained from "Seller".
